1. General
(1) The following terms and conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their independent professional activity.
(2) ingarden reserves the right to exclude users from using the website in certain cases, in particular in the event of
– access to the platform through a manual or automated process for a purpose beyond personal use or the inclusion of ingarden in a search index,
– access to the platform by automated systems or with software for data extraction (so-called “screen scraping”), whether for commercial or non-commercial purposes,
– circumventing existing restrictions in robot exclusion headers or other measures designed to prevent or restrict access to the platform,
– the use of a device, software or program that impairs or attempts to impair the functioning of the platform or
– performing an action that places an unreasonable burden on ingarden's servers, computers, or network.
2. Contractual relationships and settlement
(1) The purchase agreement is concluded with ingarden GmbH
(2) By placing products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. You will receive an order confirmation by email immediately after submitting your order.
(3) The language(s) available for concluding the contract: German
We save the contract text and send you the order details and our terms and conditions in text form. You can view the contract text in your customer login.
(4) Payments made via specified payment methods (such as credit card, invoice, bank transfer) as part of an order are processed on a case-by-case basis through a PCI-compliant payment service provider. The payment service provider receives the payments from users for ingarden into its own account and pays the corresponding booking amount directly to ingarden. Payments processed in this way are handled for and on behalf of ingarden and settle the amount due for the order.
3. Delivery terms and prices
(1) Shipping costs may apply in addition to the stated product prices. Further details regarding any applicable shipping costs can be found in the individual offers. We only deliver via shipping. Unfortunately, self-collection of goods is not possible.
(2) ingarden reserves the right to send orders containing up to 3 refill packs as well as individual shipments of wicks, wick holders, growth discs and seed pad trays without tracking.
(3) The prices stated on the product pages include statutory VAT.
4. Payment
The following payment methods are generally available in our shop:

When you place your order, you provide your credit card details. After your verification as the legitimate cardholder, the payment transaction will be processed automatically and your card will be charged.
PayPal, PayPal Express
During the order process, you will be redirected to the PayPal website. To pay the invoice amount via PayPal, you must be registered with PayPal or register first, log in with your access data, and confirm the payment instruction to us. After you place your order in our shop, we will request PayPal to initiate the payment transaction. The payment transaction will then be processed automatically by PayPal. You will receive further instructions during the ordering process.
Shop Pay
Shop Pay is an accelerated checkout where customers can save their email address, credit card, and shipping and billing information to complete transactions faster the next time they are redirected to the Shopify checkout.
Google Pay
To pay the invoice amount via Google Pay, you must be registered with Google, have activated the Google Pay function, authenticate yourself with your login credentials, and confirm the payment instruction. The payment transaction will be processed immediately after you place your order. You will receive further instructions during the ordering process.
Apple Pay
To pay the invoice amount via Apple Pay, you must use the Safari browser, be registered with the service provider Apple, have activated the Apple Pay function, authenticate yourself with your login credentials, and confirm the payment instruction. Amazon Pay
During the ordering process, you will be redirected to Amazon's website before completing your order in our online shop. Sofort by Klarna
After submitting your order, you will be redirected to the website of the online payment provider Sofort GmbH. To pay the invoice amount via Sofort, you must have a bank account enabled for online banking, authenticate yourself accordingly, and confirm the payment instruction to us. You will receive further instructions during the ordering process. The payment transaction will then be processed immediately by Sofort, and your account will be debited.
5. Retention of title
The goods remain our property until full payment is received.
6. Transport damage
If goods are delivered with obvious transport damage, please report such damage to the delivery driver immediately and contact us without delay. Failure to report damage or contact us will not affect your statutory rights or their enforcement, in particular your warranty rights. However, your cooperation helps us to assert our own claims against the carrier or transport insurance company.
7. Warranties and Guarantees

Pricing, payments and refunds
Prices. The price for all items offered for purchase through the website will be displayed on the website. Further information can be found under “Shipping” below. Payments. The website currently uses third-party payment processors. Returns, refunds and cancellations
Warranty. We offer a 2-year warranty on all our devices. We cannot provide a replacement under warranty for damage caused by the user. We are able to cover the shipping costs associated with a warranty return or replacement. Seed Pad Warranty. Our seed pads provide suitable conditions for plant growth. However, you may be entitled to a replacement seed pads if any of the following occur: no germination after 5 days, the plant is diseased, or the plant has been infested by pests. Please note that all our products are intended for indoor use. We cannot replace seed pads if the gardens have been kept outdoors. For questions regarding the seed pad warranty , please contact our support team at info.de@ingarden.com . Please include a photo of the plants in your message. Returns: We offer a 45-day, no-questions-asked, money-back guarantee. If you are not completely satisfied with your item, you can return it to us for a full refund, provided the following criteria are met: You received your order from us within the last 45 days; you provide proof of purchase (order number or an email confirming the purchase); and you are responsible for the return shipping costs. To return an item, please contact us at info.de@ingarden.com . Our support team will provide you with shipping information and, if necessary, additional details. For returned items , we require confirmation from an external location before a refund can be processed. Each customer is limited to one return or exchange per customer. Returns are only accepted for your first order. Returns must be submitted within 45 days of receiving your package and must be sent to us within 45 days of your return label being generated and sent to you. Ownership. The risk of loss and ownership of items purchased from ingarden transfer to you upon handover to the carrier. You are responsible for filing claims with the carrier for any damaged or lost shipments. Shipping. When you place an order for an item through the website, the item will be shipped to the address you provide as the “Shipping Address” during the checkout process. Damaged or defective items. All damaged packages must be reported to us within 5 working days of receipt. Please do not discard any products or packaging until all shipping issues have been resolved.
Please report damaged packages to info.de@ingarden.com . Please include the following in your message: photo or video of the damaged product(s)/package(s), description of the damage, and serial number.
8. User accounts
(1) Some of the services or functionalities offered on the platform require the creation of a user account.
(2) A user account can be created using a personal email address (including via Google) or a personal profile on a social network (e.g., Facebook and PayPal). A user account is also created when a user subscribes to the newsletter.
(3) When registering via a social network or via Google and PayPal, the user account is created using the data transmitted by the social network or Google and PayPal. Further information can be found in the privacy policy.
(4) The user is responsible for the accuracy and completeness of the personal information provided. The user is responsible to both ingarden and third parties for the use of their user account. Therefore, the user is obligated to keep their user account data confidential and may not disclose it to third parties. (6) ingarden reserves the right to temporarily suspend, irrevocably delete, or take other necessary measures to suspend user accounts if the user violates applicable law, these Terms and Conditions, or other applicable contractual terms.
(7) The deletion of a user account can be initiated by sending an email to info.de @ingarden.com .
9. Data protection
(1) The protection of personal data provided by users is of the highest priority for ingarden.
(2) ingarden collects, processes and uses personal data only if the user consents to this or if a legal provision permits it. Details can be found in the privacy policy.
10. Liability
We are always liable without limitation for claims arising from damages caused by us, our legal representatives or agents.
- in case of injury to life, body or health
- in case of intentional or grossly negligent breach of duty
- in the case of warranty promises, if agreed, or
- insofar as the scope of application of the Product Liability Act is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations), due to slight negligence on the part of us, our legal representatives or vicarious agents, our liability is limited to the amount of the foreseeable damage that typically arises at the time of conclusion of the contract.
Furthermore, claims for damages are excluded.
11. Changes to the Terms and Conditions
(1) ingarden reserves the right to amend these Terms and Conditions at any time, provided that reasonable notice is given.
(2) If the user does not object within six weeks of the announcement of the change, the amended Terms and Conditions shall be deemed accepted by the user. This fact will be pointed out when the change is announced.
12. Final Provisions
(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Unless consumers are deprived of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence, the applicable law shall only apply to the extent that it is legally binding.
(2) Should any of these General Terms and Conditions be wholly or partially invalid or contradict statutory regulations, the validity of the remaining provisions of the contract shall not be affected.
13. Dispute Resolution
(1) The European Commission provides a platform for online dispute resolution, which can be accessed via this link: http://ec.europa.eu/consumers/odr/ ; ingarden does not participate in dispute resolution proceedings before a consumer arbitration board and is not obliged to do so.
14. For deliveries to Switzerland
(1) For deliveries to Switzerland, the purchase agreement is concluded between the buyer and MeinEinkauf AG, St. Gallen (CHE-331.561.017 VAT), in accordance with our terms and conditions. MeinEinkauf AG also handles customs clearance, invoicing, and delivery within Switzerland. This service is included in the purchase price and any applicable shipping costs. To ensure smooth delivery to Switzerland, we would like to inform you, for transparency reasons, that MeinEinkauf GmbH in Konstanz, Germany (DE285677365) is also involved in the supply chain. This does not incur any additional costs for the buyer.
Cancellation policy
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise your right of withdrawal, you must inform us ( Mühlenstraße 8 a, 14167 Berlin , Germany, info.de@ingarden.com ) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but this is not obligatory.
To meet the cancellation deadline, it is sufficient that you send your notification of exercising your right of cancellation before the cancellation period expires.
Consequences of the revocation
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
